What the Department of Labour considers when assessing compliance with the Employment Equity act.

During the process of the compliance review, the director-general of the department of labour will consider several factors to determine if the organisation is complying with the employment equity act in terms of its efforts to implement transformation in the organisation.

The director-general of the department of labour will consider the following factors:

  1. How many suitably qualified people from the designated groups are currently represented within each occupational level of the organisation.

  2. To what extent did the organisation comply with the demographic profile of the National and regional economically active population.

  3. The total pool of suitably available qualified people from which the employer can promote or appoint employees?

  4. The economic and financial factors of the industry sector of the employer?

  5. The current as well as the anticipated or projected financial and economic circumstances of the organisation.

  6. The current number of vacancies within the organisation and the organisation employee movements and turnover.

  7. Comparable progress made by other organisations with similar circumstances in the same sector.

  8. Training implemented for suitably qualified people from the designated group of employees.

  9. The organisation employment equity plan implementation progress.

  10. The organisation barrier analysis and to what extent the barriers have been eliminated

  11. How many qualified people have been appointed and or promoted from the designated group.
